ROCHESTER TOWNSHIP BOARD - MEETING MINUTES

Rochester Township

Board Meeting

July 10, 2008

Members Present: Gary Donovan, Douglas Butler, Jeff Orth, Brenda Dicken, Brian Mueller, Lenny Laures, and Gary Swenson. Members Absent:

Guests: Homer Tompkins, Jeff Broberg, Brad Lewis, Gene Peters, and Valerie Coe.

Brian called the meeting to order at 7:00 PM

Minutes – Brenda Dicken made a motion to approve the June 12, 2008 minutes with proposed changes made by Gary Donovan. Douglas Butler seconded the motion; it was voted on and passed.

Audit Report - The final audit report was received from Smith Schafer and submitted to the state. Final copies were distributed.

The Mayo Woodlands by the River - Brian Mueller received a copy of the final developer’s agreement from Homer and forwarded it to our township attorney for review.

Brian Mueller and I signed the approval for vacating the land so they can set up a private easement from Krevold and Bowes. The easement would provide access to the Bowes property.

The Town Board discussed CPDC request that the Development Agreement and Plat approval adopt the Forbes approved flood elevation of 1043.6 for proposed lots 4,5, 6 and 7. There was consensus of the board to use this elevation and ask FEMA to complete a new flood study for the area.

Paving of Meadow Crossing Road. - Jeff Broberg showed three different versions of the right hand turn as it currently is, with a 20 miles per hour curve, and with a 30 miles per hour curve on Meadow Crossing Road. Brad Lewis suggested that the board look at future developments to the south, they have a potential of being larger developments with higher potential traffic from the south.

Lenny suggested that we have a meeting with the neighbors in that area and discuss the alternatives available with the intersection and the paving of the balance of Meadow Crossing Road.

Homer would like to have the balance of Meadow Crossing Road paved. He is willing to pay 50% of the cost and have the balance paid by the township with future lots, other than the Mayo Woodlands, reimbursing the township as they are built.

It was suggested there be another meeting to discuss paving of Meadow Crossing Road. They will discuss any property dedication if necessary, for those affected - Forbes, Swenson, and Lewis. Discussion would address how we swing that road to the right or left and how the road should be paid for. Mike Sheehan, Olmsted County Engineer should be asked to be present.

Conditional Use Permit – Gene Peters informed the board he is going to submit a request for a conditional use permit to spread a bio solvent (industrial byproduct) on the land in section 32 off of County Road 8. He said it would be spread on the land and disked in. It has to be spread at agronomic rates determined by MPCA after soil tests have been taken and must not exceed 50% of the fertilizer requirements.

Reports –

Deputy Valerie Coe – Valeria reported that June was a busy month with 43 calls. One was a theft of copper from the quarry.

Treasures report – Brenda Dicken made a motion to approve the Treasures Report. Gary Donovan seconded the motion; it was voted on and passed.

RT Claims – Doug Butler made a motion to approve the Rochester Township Claims number 619- 634 for $231,247.29. Gary Donovan seconded the motion; it was voted on and passed.

JPB Claims – Brenda Dicken made a motion to approve the JPB claims number 1143 – 1162 for $13,327.58. Doug Bulter seconded the motion; it was voted on and passed.

Maintenance Supervisor - Lenny reported they have started the seal coating today, but it was interrupted by rain. They completed the blacktopping for this year and the cost ran about $10,000 over budget. They will start the second mowing and have contacted other townships about bush cutting. Lenny informed us there is a shortage of salt for salt/sand in this area because of the Spring delays in barge traffic on the Mississippi.

Carinbrae Cul-de-Sac - The cul-de-sac is not built to the townships recommendations. They shaped it for water control and as built will create maintenance problems for the township. The board decided to meet with involved parties at the site and resolve the issue. Jeff Orth, Lenny Laures, and Douglas Butler will meet the designers and report back.

Board of Adjustment – No Meeting

Planning and Zoning – No Meeting

TCPA – Brenda and Lenny updated the board on TCPA. The major discussion at the meeting was the TCPA finance situation. Their income is down because of the lack of building permits in 2008.

Boulder Creek – The letter of credit has been exercised with Wells Fargo.

Road Access Plan – No action

Head Wall Study - No action

SWPPP Update – Brenda Dicken mailed the annual report prior to the due date.

Picnic - Douglas Butler suggested having the picnic on Wednesday September 3rd starting at 3pm.

Fire Letter – Gary Donovan reported the fire letter was redone and sent in. It will be presented to the Rochester City Council.

Old Salem Road Court SW - the County sent a letter to the township notifying us they will vacate the Old Salem Road Court SW to Rochester Township. Gary Donovan made a motion to accept the Olmsted County resolution #08 38 that transfers ownership of Salem Road Court SW. Douglas Butler seconded the motion; it was voted on and passed.

Salt/sand shed - Rochester and Cascade Township are each looking at building a salt/ sand shed that will hold about 400 tons of material divided into two sections. The Joint Powers Board is in the process of having plans drawn up and getting quotes in August.

Meeting Adjourned 10:20PM. Jeff Orth made a motion to adjourn the meeting. Gary Donovan seconded the motion; it was voted on and passed.
