ROCHESTER TOWNSHIP BOARD - MEETING MINUTES

April 10, 2008

Members Present: Gary Donovan, Douglas Butler, Jeff Orth, Brian Mueller, Lenny Laures, and Gary Swenson. Members Absent: Brenda Dicken

Guests: Valerie Coe, Dan McPearson, Mike Gowin, Bill Tointon

Brian called the meeting to order at 7:00 PM

Minutes – Doug Butler made a motion to approve the March 13, 2008 minutes. Gary Donovan seconded the motion; it was voted on and passed.

Swearing in of new officers - Gary Swenson swore in Jeff Orth and Douglas Butler. Gary Swenson was sworn in at the Olmsted County Townships meeting on March 27th.

Reports:

Deputy Valerie Coe – Deputy Valerie Coe reported they found a discarded gas container in the township that was probably used for meth. Other than that, it was a pretty quiet month in our township.

Treasurer Report- Gary Swenson mentioned that he transferred $25,000 from the MM account to the checking account on March 3, 2008. Douglas Butler made a motion to approved the treasurer’s report. Gary Donovan seconded the motion; it was voted on and passed.

Checking & Money Market:

Rochester Township Claims - Gary Donovan made a motion to approve Rochester Township claims # 576 – 588 for $24,359.16. Douglas Butler seconded the motion; it was voted on and passed.

Joint Powers Claims - Gary Donovan made a motion to approve the JPB claims #1074 – 1104 for $17,604.91. Jeff Orth seconded the motion; it was voted on and passed.

Maintenance Supervisor Road Report – Lenny Laures reported they finished sweeping in Cascade Township and started this week in Rochester Township. Lenny and Mike both took their test for chemical application. Lenny has been contacted by a couple of townships to use the wet blade.

Road Tour - Lenny estimated that we would be reclaiming and resurfacing about 1 3/4

Miles of roads this summer. The roads or sections of roads are Valley Court SW, 34th Avenue, Valley View Road, Meadow Ridge Drive, and Conway Court.

Board of Adjustment – no meeting

P& Z reported - Douglas Butler reported that they met on Tuesday night and approved the Cairnbrae Estates Development Agreement. The Board Requested the P & Z Commission to review the proposed “Access Management Ordinance” at their next meeting and give direction to the board regarding it.

P&Z Commission - Bill Tointon reported the Planning Commission passed the revised Cairnbrae Estates Development Agreement. It was discussed who should be named on the surety agreement. Doug Butler moved to have the Developer’s Agreement amended to read that Rochester Township would hold the surety document. Jeff Orth seconded the motion; it was voted on and passed.

Douglas Butler made a motion to approve the Developer’s Agreement as amended. Jeff Orth seconded the motion; it was voted on and passed.

Douglas Butler made a motion to approve the final plat as approved by the planning commission. Gary Donovan seconded the motion; it was voted on and passed.

Roger Ihrke said that he was approached by CRS and they are interested in purchasing the Ivy Lodge and would change the use to a (eating disorder) weight loss group home. Roger suggested and was asking permission to contact our lawyer (Peter Tiede) to see if this was a recognized disablility and qualified under the conditions of the conditional use permit. Gary Donovan made a motion to authorize Roger Ihrke to contact our town attorney ( Peter Tiede ). Jeff Orth seconded the motion; it was voted on and passed.

Roger Ihrke said that our Rochester Zoning Ordinance Number 07-01 expired on March 8th, 2008. The board discussed extending this document. Jeff Orth made a motion to extend this ordinance another 18months. Douglas Butler seconded the motion; it was voted on and passed.

Roger suggested that we contact our attorney on the correct language for this ordinance and not wait for the county to redo theirs.

Head Wall Study - Mike Gown from McGhie and Betts reported on our Head Wall Study ranking process. Douglas Butler made a motion that we accept the April 2008 survey of existing driveway entrances as presented by McGhie & Betts, Inc. Gary Donovan seconded the motion; it was voted on and passed.

TCPA - Lenny reported that the state has made some changes in septic system requirements, one of the changes is a second verification of the septic report verifying the drain field. They will build the septic systems to Olmsted County’s four feet level and verify to the state’s requirement of three feet for the second verification.

Meeting adjourned – Douglas Butler made a motion to adjourn the meeting. Jeff Orth seconded the motion; it was voted on and passed.
