ROCHESTER TOWNSHIP BOARD - MEETING MINUTES

Members Present: Gary Donovan, Brenda Dicken, Brian Mueller, Douglas Butler, Jeff Orth, Lenny Laures and Gary Swenson. Members Absent:

Guests: Bruce Borgerding

The meeting was called to order by Brian Mueller at 7 PM.

Gary Donovan made a motion to approve the minutes of the March 12, 2009 board meeting as amended. Brenda Dicken seconded the motion; it was voted on and passed.

OLD Business:

Burn Permit – Jeff Orth and Lenny Laures informed the board on the DNR Burn Permit proposed process as clarified by Mr. Hines from DNR. Lenny said most of the townships in Olmsted County have turned down the electronic process. The board decided to continue issuing burning permits as in the past until we get more information.

Debra Poire – Brenda Dicken sent out a second letter requesting her to clean up property by April 30th, or the township may do it and bill her for the expense. Brenda also sent a copy to her sister Michelle Poire. If Brenda doesn’t see it cleaned up by the next meeting we will discuss it then.

Road Tour - The board set our annual road tour at 9:30 Wednesday, April 15, 2009.

JPB Review - The board reviewed the JPB meeting.

Olmsted County Highway Maintenance Agreement – Brian Mueller made motion to accept the road agreement rates as stated. Brenda Dicken seconded the motion; it was voted on and passed.

Deputy Val Coe –Val reviewed the sheriff calls for the township during the past month. There was a dog bite on 40th street, a theft of construction equipment off of Meadow Crossing Road, and a roll over on County Eight.

Treasurer - Gary Donovan made a motion to approve the treasurer’s report. Douglas Butler seconded the motion; it was voted on and passed.

RT Claims – Brenda Dicken made a motion to approve Rochester Township claims #773 to 789 for $10,537.87. Douglas Butler seconded the motion; it was voted on and passed.

JPB Claims – Brian Mueller made a motion to approve JPB claims #1378 to 1400 for $11,027.42. Gary Donovan seconded the motion; it was voted on and passed.

Maintenance Supervisor – Lenny Laures reported on spring projects that they are working on. They have been cutting trees up and removing brush in the right-of-way; they will also be working on filling in around the salt/sand shed.

Board of Adjustment -No meeting

P&Z Commission - No meeting

TCPA - Brenda Dicken reported that TCPA decided to keep Geoff Griffin as septic inspector. Roger reported their financial situation has improved a little and have received some of the special assessments from member townships. Brenda Dicken made a motion to rescind last month recommendation to have Matt Fowler as our septic inspector. Gary Donovan seconded the motion; the motion was voted on and passed.

The board is recommending that TCPA have Jeff Griffin as our septic inspector and administrator. Our board discussed recommending a multi year contract with an annual review and an opt out clause in the contract. Brenda Dicken made a motion to recommend to TCPA that they enter into a multi year contract with an annual review and an opt out clause in the contract with Jeff Griffin. Gary Donovan seconded the motion; it was voted on and passed.

The board reviewed the developed a grading plan and checklist for developments TCPA and asked the townships to approve it. Gary Donovan suggested we add this policy of sub-division ordinance. Brenda Dicken made a motion that we adopt the TCPA grading plan policy and checklist and add it to our township sub-division ordinance after a public hearing. Gary Donovan seconded the motion; it was voted on and passed.

Cost Share Agreement with Homer Tompkins on Meadow Crossing Road – Our township attorney put in the agreement that if any individual argues to have his per lot fee of ($5,000) reduced Homer Tompkins Inc. would pay the difference up to the $5,000. Homer has objected to that clause. Gary Donovan suggested that we drop that clause. The board discussed and agreed to keep the assessment per lot of $5,000 and have all lots that benefit from the road be assessed.

Brian Mueller made a motion to adjourn the meeting at 9:45 PM. Douglas Butler seconded the motion; it was voted on and passed.
