ROCHESTER TOWNSHIP BOARD - MEETING MINUTESRochester Township Board Meeting December 13, 2007 Members Present: Brenda Dicken, Gary Donovan, Douglas Butler, Jeff Orth, Brian Mueller, and Gary Swenson. Members Absent: Guests: Yves Quellette, Rita H. Mayo, Dennis Bowe, Sherrie Bowe, Bill Tointon, & Dan McPherson Call to order - Brenda called the meeting to order at 7.01Pm Minutes of the November 8, 2007 meeting Douglas Butler made a motion to approve the minutes as corrected. Gary Donovan seconded the motion; it was voted on and passed. Drifens/Ivy Lodge outdoor lighting issue - Gary Donovan talked to Derek Mazula at the Ivy Lodge about the lighting. He called back after reviewing the CUP and said he would address the lighting with his lighting contractor. Brenda said the board should send him a notification that he is out of compliance with the CUP and ask him to let us know what and when he is going to correct the situation. The light is extending out into the neighborhood. Douglas Butler suggested that we give him 30 days to let us know what he is going to do and when to correct the issue. There were four board members that went to the site and witnessed the lighting. Gary Donovan made a motion to authorize Brenda to send a letter telling Derek Mazula owner of the Ivy lodge that he was out of compliance with the CUP # 07-01 and he has 30 days to let us know what he will be doing to rectify the situation. Douglas Butler seconded the motion; it was voted on and passed. Jeff Orth said it should be noted the current driveways were designed for horse and buggy transportation and not designed for today’s commercial vehicles. A neighbor said his grass was trampled from traffic, construction material was on his driveway, and mud washed on his property. Gary Donovan made a motion to add to the letter the parking and transportation problems the neighbors have had with traffic coming to and from the Ivy Lodge. Douglas Butler seconded the motion; it was voted on and passed. Boulder Creek Roads status - Brenda Dicken said she received a call from Steve Holtegaard; he was very upset and refused to pay the bill we sent him. The bill was for work in Boulder Creek on a driveway and ditch that township required. Brenda received a letter from Steve Holtegaard saying the township requested the contractor to put in pads of asphalt by the mailboxes and he paid for that. Steve is asking for reimbursement for the extra expense. Jeff Orth suggested that we turn our township bill over to the bond company for payment. Then, Gary Donovan suggested that we notify him he has 30 days to pay the bill, if it isn’t paid it will be turned over to the bond company. Jeff Orth made a motion we start the process to have the Township bill paid from the bond. Brian Mueller seconded the motion; it was voted and passed. Issues for State Legislators - Brenda Dicken asked if there are any issues coming up that we might want to invite or contact our local legislatures about. Jeff suggested we work on a transportation bill. Lenny suggested we ask them to our January meeting. Township Recognition Dinner plans - Dinner plans are set for next January 11th at the Shady Hill Grill. Deputy Valerie Coe – Things have been fairly quiet this month and Valerie gave us our monthly activity report. TREASURER's REPORT
Douglas Butler made a motion to accept treasurer’s report. Gary Donovan seconded the motion; it was voted on and passed. Gary Donovan made a motion to approve the December Rochester Township claims # 519 – 534 for $107,978.33. Brian Mueller seconded the motion; it was voted on and passed. Jeff Orth made a motion to approve December JPB claims # 959 thru 988 for $29207.33. Gary Donovan seconded the motion; it was voted on and passed. Maintenance Supervisor – Lenny Laures reported they went through a fair amount of salt sand this past month and removed a lot of snow. He is still working on the purchase of a new truck. Board of Adjustment – Didn’t meet. P&Z Commission (Preliminary Plat for Carnie Estate – Bowe Property) - Gary Donovan said the Planning and Zoning Commission are recommending the board approve the preliminary plat for the Bowe property. Lenny Laures requested they remove the previous turn around bulb that is about 100 feet before the property in this development. Bill Tointon will check and see what is involved in removing the previous turnaround bulb mentioned above. Jeff Orth made a motion to approve the preliminary stated by the planning commission. Gary Donovan seconded the motion; it was voted on and passed. TCPA – Brenda Dicken reported on the meeting. TCPA fees are running about three years behind the county rates, so they discussed raising the fees to the 2005 county rates. Lenny said the increase would be about 4.5%. Jeff Orth suggested that TCPA’s reserve goal should be 50% to 100% of years operating budget. Lenny said TCPA’s current reserve is about 30%. LGA - Brenda Dicken said that they are working with the LGA treasurer on getting the LGA closed down. Roger Carlsen/Bamber Valley Estates road maintenance letter- Brenda Dicken drafted a letter for the Home Owners Association, the residents on the east side of West Hill Drive, detailing the fee of $312.98 per lot for 2008. It was sent to Roger Carlsen, the developer. Status of Einck Property development – It’s in process. Update on McGhie & Betts driveway headwall study – The first phase was to develop the criteria to identify Headwalls in the township and report it back to the town board. The next phase is to review the Headwalls identified and identify the level of concern or risk with them. This will be a time consuming phase and will cost about $3,000. The board’s decision is to move forward with the project and ask the townships that circle Rochester if they would like to participate in the study. Jeff Orth suggested we wait to see if another township will collaborate with us. Gary Donovan made a motion to go ahead with the study and pay the $3,000 required for Phase II and to proceed. We should also contact the other townships around Rochester to see if they would be interested in sharing the cost of the study. Douglas Butler seconded the motion. This motion was then tabled until next month. Results of swimming pool tax referendum – It was defeated. SWPPP update - Brenda Dicken updated the board on her ongoing work on the SWPPP report. Jeff Orth made a motion that Brenda submit the report and then contract with McGhie and Bets if necessary on completing the report. Douglas Butler seconded the motion; it was voted on and passed.
