Thursday, July 9, 2009

Board Minutes

Members Present: Gary Donovan, Brenda Dicken, Douglas Butler,

Brian Mueller, Jeff Orth, Lenny Laures and Gary Swenson.

Members Absent:

Guests – Elizabeth Dunn, Yves Ouellette, Bruce Borgerding, Steve Holtegaard and Val Coe.

The meeting was called to order at 7:00 PM by Jeff Orth.

Minutes –Doug Butler made a motion to approve the June 11, 2009 minutes as amended. Gary Donovan seconded the motion; it was voted on and passed.

Boulder Creek Development - Steve Holtegaard requested permission to put on the 2nd lift on the 3rd phase of Boulder Creek Development. It was discussed, and stated that Steve Holtegaard could put the 2nd lift on at anytime, but the town will not accept the road until there are over 50% of the houses in. Steve also asked if the township would ever take over the maintenance of the private roads within the sub-development. It was stated the township would never take over a private road unless it was brought up to township specifications. He also said there was a signpost that needed to be replaced or corrected. The township will replace the damaged sign.

Drifens – A Chapter 7 Petition has been filed for liquidation of Drifens in Rochester. Filed June 12, 09-34074 – assets $1,127,264, Liabilities $2,338,877 in the Star Tribune.

Elizabeth Dunn & Yves Ouellette are neighbors requesting that we rescind the CUP for Drifens. It was discussed, and decided we will refer this to our attorney Peter Tiede to see if we can rescind the CUP.

Fences around Pools - Lenny Laures said there are several people in our township and Cascade Township that will be getting a letter from Peter Tiede regarding fences around pools.

Deputy Val Coe – Deputy Val Coe reviewed the incidents that happened in Rochester Township this past month.

Paving Meadow Crossing Road – Work is still pending waiting for information from attorney. It was discussed if we don’t have something by next meeting we will have to find another area in the township to pave this year.

Railroad by Pass - Next meeting scheduled at the end of the month on the 23rd of July.

Parking Ordinance - Brenda Dicken suggested that we approve the language that Cascade Township used in it’s parking ordinance and then have Planning & Zoning schedule a public hearing on the ordinance. Brenda read the revised language in the proposed ordinance. Lenny said the tickets issued will be prosecuted by the county attorney. Brenda made a motion to accept the language in proposed parking ordinance prior to public hearing. Gary Donovan seconded the motion; it was voted on and passed.

Land Use Plan – Brenda and Lenny updated the board on some of proposed changes.

Storm Water meeting – It was an educational meeting put on by the county for those interested.

Treasurer’s report - Doug Butler made a motion to approve the treasurer’s report and Brenda Dicken seconded the motion; it was voted on and passed.

RT claims - Gary Donovan made a motion to approve the claims# 822 – 837 for $117,693.48. Brenda Dicken seconded the motion; it was voted for and approved.

JPB Claims - Douglas Butler made a motion to approve the JPB claims #1458 – 1484 for $10,973.71. Gary Donovan seconded the motion; it was voted on and passed. Brian Mueller did not vote because of a conflict of interest.

Lenny’s Report - Lenny said they have been out using the milling machine and it is working just great. We filed a first report of injury for Chris Lien’s hand injury. Discussed weeds in the roadways and Lenny suggested that we use Barth Spraying to take care of some of the weeds in the ditch. Gary Donovan made a motion that we contact Barth Spraying to take care of some the weeds in our township. Brenda Dicken seconded the motion; it was voted on and passed. They will be working on 40th street in the next week. Jeff mentioned the sidewalks on the lower portion of 40th street going down the hill are over grown with weeds. Lenny will talk to Mike Sheehan about the weeds.

Silt run off up in Mayo Woodlands and Traffic control - Brenda received a call from a resident up in Mayo Woodlands saying there was silt and mud running off the property where a new house is being built. Our ordinance states there can be no run off of mud or silt from the building site. Lenny is going to talk to the builder.

She was also concerned with the speed people drive in the area. The roads are posted at 30 MPH.

Olmsted County Township Assn. Meeting – On July 23, 2009 Rochester and Marion Township will host this meeting. We will plan for it in the garage.

Picnic - Douglas Butler suggested we have our annual picnic on August 27 and the date was approved.

Meeting Ajourned 9:45 - Douglas Butler made a motion to adjourn the meeting. Brain Mueller seconded the motion; it was voted on and passed.
