ROCHESTER TOWNSHIP BOARD - Proposed Parking Ordinance

Rochester TOWNSHIP PARKING ORDINANCE

Ordinance Number 09-1

(Pursuant to Minn. Stat. §§ 169.04 and 365.10 subd. 17)


The board of supervisors of the town of Rochester ordains:


Subd. 1. Parking Restrictions. No person shall park a vehicle, or permit or allow a vehicle to remain parked, upon any Town roadway continuously, without being moved, for more than 24 hours. The parking of a vehicle, or permitting or allowing the parking of a vehicle, such that only a portion of the vehicle is upon the roadway of any Town roadway shall be considered the same as if the entire vehicle were so parked.


Subd. 2. Seasonal Parking Restrictions. No person shall park a vehicle or permit or allow a vehicle to stand within any Town roadway any time when there are two (2) or more inches of unplowed snow and or ice on any Town roadway adjacent to the vehicle, as determined by a Road Maintenance Supervisor. 


Subd. 3. Vehicles May Be Ticketed and Towed. Any vehicle found to be in violation of this section, or which obstructs traffic and / or presents a public safety issue may be tagged by a law enforcement officer or any Town official, and the owner of the vehicle shall be charged by citation, and if the vehicle constitutes a public safety hazard, it may be towed to a place of storage, at the owner's expense, and not released to the owner until all expenses of the towing have been paid.


Subd. 4. Fines and Fees. The first violation will result in a warning ticket. If the ticketed vehicle is not removed from the roadway within 6 hours of the time of ticketing, or there are subsequent violations by the same vehicle that vehicle may be towed at the owner’s expense and a fine of $100 payable to the Township will be imposed.


Subd. 5. Definitions.


(1) Vehicle. "Vehicle" means any device for carrying one or more passengers, goods, or equipment, whether self-propelled or not.


(2) Roadway. "Roadway" means that portion of a public street, or alley improved, designed, or ordinarily used for vehicular travel, exclusive of the sidewalk or shoulder. In the event a roadway includes two or more separate roadways, the term "roadway" as used herein shall refer to any such roadway separately but not to all such roadways collectively.


(3) Town. “Town” means Rochester Township, Olmsted County, Minnesota.


(4) Town Official. “Town Official” means any elected supervisor or the Town Clerk of the Town.


Subd. 6. Effective Date. This Ordinance shall be effective immediately upon its passage.
