ROCHESTER TOWNSHIP BOARD - MEETING MINUTESThursday, August 9, 2007 Present: Brian Mueller, Jeff Orth, Gary Swenson, Gary Donovan, Brenda Dicken, and Douglas Butler Guests: Art Reckinger, Deputy Valerie Coe, Chris Caffes, and Kevin Taylor Brenda Dicken called the meeting at 7:00PM Gary Donovan made a motion to approve the minutes as amended. Douglas Butler seconded the motion; it was voted on and passed. New Business: Pending request from Gary Einck for storage building in Industrial Zone – Gary Einck requested that we wave the planning and zoning fee, it was discussed and no action taken. MPCA notice of hearings on amendments to MN Rules, Chap 70-50 on standards to protect discharge to the Mississippi River - These changes might affect our zoning ordinances; we might wish to attend the meeting. September 12 2PM MPCA office at Woodland Drive. Kevin Taylor and Chris Caffus . Chris Caffus is an agent for Kevin Taylor who wants to purchase property off of 40th Street and 60th Avenue. They wanted to see if the board thought a variance could be plausible. Gary Donovan said the board would consider a variance, they will have to contact our zoning administrator to schedule a Board of Adjustment (Variance) meeting. County Public Hearing on proposed township swimming pool fees – Brenda and Lenny updated the board on the County Public Hearing and resulting concerns and solutions to those concerns. Proposed Electric Transmission Line corridor - Brenda showed the board proposed electrical transmission lines that will cross the county. It looks like none of them will cross through Rochester Township. Review of the developer’s agreement with Roger Carlsen – Roger Carlsen promised to put a 2-inch lift on the road and the township will collect a fee per residence. He currently has 9 houses on the township road plus 3 to 4 vacant lots. Lenny said the road is currently in rough shape and the developer plans to put a lift on next summer in 2008. The board will notify Roger Carlsen that we are going to start the annual assessment for road maintenance and bill the homeowners association for those lots on record as of January 1st 2008 and billed to be paid by April 1st of 2008. The board will adjust the fee agreed to in the developer’s agreement based on the Engineering News Constructions Cost Record Index. Reports: Deputy Valerie Coe’s Report – Valerie reported very few incidents this past month in Rochester Township. Another burglary at Meadow Lakes. The National Night Out was well attended. Doug Butler made a motion to approve the treasurer’s report. Brian Mueller seconded the motion; it was voted on and passed. Jeff Orth made a motion to approve Rochester Township claims # 458 - 469 for $18,980.16. Gary Donovan seconded the motion; It was voted on and passed. Douglas Butler made a motion to approved the JPB Claims #868 - 885 for $9,410.24. Jeff Orth seconded the motion; it was voted on and passed. Rochester Township passed a resolution #07-01 approving an increase in the property & casualty deductible from $250 per incident to $1,000. They also set the building evaluation insured limit at $550,000 replacement cost, up from the $300,000 previously stated. Lenny will get at least two estimates for replacement costs to see if we are properly insured. If we find that the replacement cost is above $550,000 we will consider adjusting it at a future meeting. Road Maintenance Report – Lenny said he talked to Kent Sulem about the township’s parking ordinance. Kent suggested that we change our ordinance to township wide rather than strictly residential areas. Lenny suggested that we discuss this parking ordinance at the next meeting with the sheriff’s representative & other townships’ members so that we have a parking policy that is enforceable and the same for all townships. Stripping is done on Meadow Crossing, ditch cleaning, through the second mowing; we need to get a commercial license for spraying chemicals. Jeff suggested that we work with Olmsted County on purchasing the chemical applicator to our bush cutter. P&Z Commission Report – Gary/Doug - No report Board of Adjustment Report – Jeff – No Report Report from County Township Officers meeting – Brenda reported on the shore land ordinance, the 50 ft. buffer on any waterway. Judy Ohly said the townships could use the city kennels on a space available basis, because the county paid for 10% of the operations. TCPA Report – Lenny / Brenda reported on August 8th meeting. LGA Report – Brenda /Lenny reported that Kent Sulem developing a mission statement and process to role LGA into MATTS. VI. Old Business Status of Headwall Study – In process. Township Picnic plans – New date for picnic September 10th from 4 to 7PM. VII. Other Business – Noise Ordinance - Art Reckinger said there was a party in his neighborhood where the noise level exceeded the township level of 85 DB. He suggested that the township have a permitting system for residents who wish to have a party. This would notify residents and limits could be established. Art suggested establishing a DBA or DBC limit. No action was taken. Meeting Adjourned at 11:10 PM Gary Donovan made a motion to adjourn at 11:10 PM.
