Minutes

Members Present: Gary Donovan, Douglas Butler, Brenda Dicken, Brian Mueller, Jeff Orth, Lenny Laures and Gary Swenson. Members Absent:

The meeting was called to order by Brian Mueller at 7 PM.

Gary Donovan made a motion to approve the minutes of the board meeting November 13, 2008 as amended. Douglas Butler seconded the motion; it was voted on and passed.

Old Business:

CPDC Update - Gary Donovan gave an update on the road access through the Moehnke property.

Old Valley Road update – On behalf of the petitioners, Gary Donovan presented the board with two petitions, one for vacating and one for establishing a portion of Meadow Crossing Road, formerly referred to as Old Valley Road. Gary Donovan made a motion to accept the petitions to vacate and establish a portion of Old Valley Road as presented. Brenda Dicken seconded the motion; it was voted on and passed. We need to have a public hearing and it was decided we would hold it at our next township meeting after 7:00 PM.

SWPPP Update - Brenda Dicken reported that Don Kyser from MPCA accepted for public notice our third revision of the Township SWPPP.

Audit Proposal Update – Smith Schafer and Associates LTD. updated their three year proposal leaving the cost the same each year as we requested.

Cairnbrae cul-de-sac – Brenda Dicken and Gary Donovan met with Dan McPhearson and Bill Tointon to clarify the process that brought about the required re-grading of the Stembrae Court cul-de-sac. Bill Tointon from McGhie & Betts, Inc. requested that we send them two letters dealing with the Cairnbrae cul-de-sac. The first letter should state that the township requested the cul-de-sac be re-graded. The second letter would deal with reducing the letter of credit for work completed to date. Based on the amount of work done and paid for, the board calculated that an amount of $22,500.00 was sufficient to cover the balance of the work, as well as cover the warranty requirement. Doug Butler asked Gary Donovan if would write the letters and Gary said h would.

The board discussed the conflict of interest where Jeff Griffin was inspecting work on items he bid on. It was suggested that we need a letter of understanding with him stating he cannot inspect work that he has designed.

Gary Donovan made a motion we send out the letters requested. Brenda Dicken seconded the motion; with Brenda, Brian and Gary for and Jeff and Douglas against. The motion passed.

Reports:

Deputy Valerie - Val updated the board on what happened in the township..

Treasurer - Gary Swenson Brenda Dicken made a motion to approve the treasurer’s report. Douglas Butler seconded the motion; it was voted on and passed.

RT Claims – Gary Donovan made a motion to approve Rochester Township claims #716 to 735 for $185,658.91. Brenda Dicken seconded the motion; it was voted on and passed.

JPB Claims - Brenda Dicken made a motion to approve JPB claims #1248 to 1290 for $130,671.34. Douglas Butler seconded the motion; it was voted on and passed. Brian Mueller abstained from voting.

Maintenance Supervisor – Lenny Laures reported the salt/sand sheds are up and full. We still need to do some landscaping around them. As part of the construction of the salt/sand sheds they had to move the fuel barrel and reconnect power to the fuel barrel. The new truck has a problem with the blade not wearing evenly.

Board of Adjustment -No meeting

P&Z Commission - No meeting

TCPA – Brenda reported on the last TCPA meeting. They are still losing money. They adjusted the fees from 2003 to 2007 County level. People’s Cooperative has proposed a new contract for $750 per month for rent. They are looking for an alternative location. Jeff Orth made a motion that we authorize an offer to contract with TPCA for space at the township for no more than $150.00 per month. Brenda Dicken seconded the motion; it was voted on and passed.

Other Business –

Recognition/Christmas Party – The party will be at the Holiday Inn South Friday January 9th..

Brenda Dicken sent a letter to Debra Poire requesting her to clean up the unsightly debris left after the fire on her property.

Douglas Butler made a motion to adjourn the meeting at 9:55 PM. Gary Donovan seconded the motion; it was voted on and passed.
